Terms of Use

1. Platform Role
Sawyl provides a structured record system for documenting property conditions at the time of handover. The platform enables users to create, seal, and share condition records containing observations, notes, and photographic evidence.
Sawyl does not verify, guarantee, or interpret the accuracy of records created by users. Records reflect the observations of the parties who created them. Sawyl makes no representation as to the completeness, accuracy, or reliability of any record.
Users are solely responsible for the content they upload, including all text, images, and notes submitted to the platform.
2. Permitted Use
Users may only use Sawyl to document property conditions in connection with legitimate rental, lease, or property management activities.
Users may only upload images and notes that relate directly to documenting property condition during inspections, move-ins, or move-outs. Any other use is not permitted.
3. Prohibited Content
Users may not upload or submit:
- Illegal material of any kind
- Sexual content or nudity
- Violent, abusive, or distressing imagery
- Copyrighted material not owned by the user
- Images or content unrelated to property condition documentation
- Personally identifiable information of third parties without their consent
Violation of these restrictions may result in immediate content removal, account suspension, or permanent deletion. Sawyl reserves the right to report illegal content to appropriate authorities.
4. Content Ownership
Users retain ownership of the images and records they upload to Sawyl. Uploading content does not transfer ownership to Sawyl.
By uploading content, users grant Sawyl a non-exclusive, worldwide licence to store, display, and transmit the content as necessary to operate the platform, including generating signed access URLs and displaying content to parties with a valid verification link.
5. Platform Neutrality
Sawyl acts only as a technical record infrastructure. The platform does not participate in, adjudicate, or take any position in disputes between parties to a property condition record.
Sawyl sealed records may be referenced as part of a dispute resolution process, but Sawyl itself is not a party to any such process and provides no legal advice or interpretation of records.
6. Account Responsibility
Users are responsible for maintaining the security of their account credentials. Any activity conducted under a user's account is the responsibility of that user.
Sawyl reserves the right to suspend or terminate accounts that violate these terms, engage in abusive behaviour, or accumulate repeated content reports.
7. Data Retention
Sealed property condition records are preserved in accordance with the Sawyl Condition Record Standard. Once sealed, records are immutable and are not deleted when a user account is closed or deleted.
This retention policy exists to protect the integrity of records that may have been shared with counterparties, verified by third parties, or used in formal proceedings. Records sealed prior to account deletion remain accessible via their verification link.
8. Disclaimer of Warranties
The Sawyl platform is provided on an "as is" basis. Sawyl makes no warranties, express or implied, regarding the platform's availability, reliability, or fitness for any particular purpose.
To the extent permitted by applicable law, Sawyl's liability to any user in connection with their use of the platform is limited to the amount paid by that user to Sawyl in the three months preceding the relevant claim.
9. Changes to These Terms
Sawyl may update these terms from time to time. Continued use of the platform after changes are published constitutes acceptance of the updated terms. Material changes will be communicated to registered users.
10. Governing Law
These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
